RE: The tariff classification of a carrying bag from China

Dear Ms. Pendris:

In your letter dated June 16, 2011, you requested a tariff classification ruling. Your sample will be returned to you.

Style 68790 is a rectangular-shaped carrying bag. It is designed to provide storage, organization, protection and portability to digital video disks (DVD) during travel. The majority of the body of the bag is constructed of polyvinyl chloride (PVC) plastic sheeting. As such, the essential character of the bag is imparted by the polyvinyl chloride, General Rule of Interpretation 3(b) noted. The top and bottom panels of the bag are constructed of a man-made textile material. It has an unlined storage compartment with no additional features, a nylon zipper closure along three sides, and two webbed carrying handles. It measures approximately 20.5” (L) x 5” (W) x 5” (D).

The applicable subheading for the carrying bag will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports and similar bags: with outer surface of sheeting of plastic or of textile materials: other. The rate of duty will be 20 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
